Risk Disclosure and Not-Financial-Advice Disclaimer
Last updated: 7 September 2026
This disclaimer governs your use of the XBreakout marketing site (https://xbreakout.com) and the XBreakout application (https://app.xbreakout.com), together the "Service", operated by [ FILL IN: your legal entity / name ] ([ FILL IN: entity type (e.g. sole proprietor) ]), of [ FILL IN: your business address ], Sri Lanka ("we", "us", "our"). Please read it carefully. By accessing or using the Service you acknowledge that you understand and accept the limitations and risks described below. If you do not agree, do not use the Service.
What XBreakout Is — and What It Is Not
XBreakout is a software tool for charting, trade journaling, trader education and market simulation. It provides native price charts, a guided trading plan, automatic journaling of your simulated trades, psychology and performance analytics, and paper (simulated) trading. It is intended to help you study markets, structure your process and reflect on your own decisions.
XBreakout is not a broker, dealer, exchange, trading venue, money-services business, custodian, investment adviser, portfolio manager, financial planner or any other kind of regulated financial intermediary. We are not registered with, licensed by, or authorised or supervised by any securities, commodities, banking, forex or other financial regulator in any jurisdiction, and nothing in the Service should be taken to imply otherwise. We do not act as your agent and we owe you no fiduciary, advisory or brokerage duty.
No Investment, Trading, Tax or Legal Advice
Nothing made available through the Service constitutes, or is intended to constitute, investment advice, trading advice, financial advice, tax advice or legal advice, and nothing is tailored to your individual financial situation, objectives, risk tolerance or needs. In particular:
- We do not provide, and the Service does not generate, any buy, sell or hold recommendation, trade signal, price target, forecast or "call" of any kind.
- Any tools, indicators, drawings, templates, analytics, sample plans, educational material or default settings are provided for information, study and self-directed analysis only, and must not be relied upon as a recommendation to enter into any transaction.
- Nothing on the Service is an offer, solicitation, inducement or invitation by us to buy, sell, subscribe for or deal in any security, cryptoasset, currency, contract for difference, derivative, commodity or other financial instrument, in any jurisdiction where such an offer or solicitation would be unlawful.
Any decision you make to trade, invest or transact — and all consequences of that decision — are entirely your own responsibility. You are solely responsible for evaluating the merits and risks of any transaction and for complying with the laws applicable to you.
No Client Funds and No Real Orders — Paper Trading Only
XBreakout does not hold, receive, transmit, custody or control any client money, cryptoassets or other financial assets. The Service does not connect to any live brokerage or exchange account for the purpose of dealing, and it executes no real-money orders.
All trading functionality in the Service is paper trading: it is a simulation that uses virtual balances and hypothetical positions. Simulated fills, profit and loss, fees, margin, leverage and liquidation figures are estimates produced by our software for practice and study. They do not represent, and will not become, actual positions, actual executions or actual gains or losses, and no simulated result creates any entitlement to real funds.
Hypothetical and Simulated Performance Has Inherent Limitations
This is the most important clause in this disclaimer, and it applies to all performance figures, equity curves, R-multiples, win rates, streaks, psychology scores and other analytics that the Service derives from your paper trades.
Hypothetical and simulated performance results are not real, do not reflect actual trading, and do not indicate, predict or guarantee future or real-world results. Simulated trading differs from live trading in fundamental ways, and simulated results have many inherent limitations, including but not limited to the following:
- Simulated trades are designed with the benefit of hindsight and are not subject to the financial risk, emotional pressure, discipline lapses and hesitation that affect decisions when real money is at stake.
- The simulation may assume fills, prices, spreads, slippage, latency, liquidity, fees, funding or leverage that would not have been available to you in a real market, especially in fast-moving or thin conditions.
- No simulation can fully account for the impact that real orders, real market events, gaps, halts, outages or counterparty behaviour would have had.
- Because simulated results are prepared by software, they are subject to the possibility that the model, data or your own inputs are incomplete or incorrect.
For these reasons, strong simulated performance on XBreakout provides no assurance whatsoever that you would achieve — or even approach — comparable results trading real markets with real money. Past performance, whether real or hypothetical, is not a reliable indicator of future performance.
Trading Real Markets Involves Substantial Risk of Loss
Trading and investing in cryptoassets, forex, metals and other financial instruments carries a high level of risk and is not suitable for everyone. Prices can move rapidly and unpredictably, and the use of leverage or margin can magnify both gains and losses. You can lose some, all, or in some leveraged products more than the amount you commit, and you should never trade with money you cannot afford to lose.
Before trading any real market or committing real money, you should carefully consider your own circumstances and seek independent advice from a licensed and appropriately qualified financial, legal and tax professional in your jurisdiction. Skill demonstrated in the XBreakout simulation is not a substitute for that advice and does not reduce the real risks of live trading.
Market Data May Be Delayed, Estimated or Inaccurate
Charts and quotes in the Service are drawn from third-party market-data providers (for crypto, Binance; for forex and metals, Twelve Data). This data is provided "as is" and may be delayed, incomplete, interrupted, estimated, adjusted or otherwise inaccurate, and it may differ from the prices available on any particular broker or exchange at any given moment. Where true source data is unavailable, some values (including certain volume, tick or order-flow figures) may be approximations rather than exact records.
You must not rely on the Service as your sole source of market data, and you should independently verify any price or figure with your own broker, exchange or another reliable source before acting on it. We do not warrant the accuracy, timeliness, completeness or availability of any data, analytics or output, and we are not responsible for any decision made, or action taken, in reliance on them, to the fullest extent permitted by applicable law. Nothing in this disclaimer limits any liability that cannot lawfully be excluded, or affects the mandatory consumer-protection rights available to you in your country of residence.
Your Responsibility and Eligibility
The Service is intended only for individuals aged 18 or over who are legally permitted to use it in their jurisdiction. You are responsible for ensuring that your use of the Service, and any trading you undertake elsewhere, complies with all laws, regulations and rules that apply to you.
Professional Review
This disclaimer has been prepared as an engineering and risk-management document and is not a substitute for legal advice; you should have it reviewed by a qualified lawyer in the operator's jurisdiction before relying on it.
